The Darkstims Limited mobile message service (the “Service”) is operated by Darkstims Limited (“Darkstims,” “we,” “us,” or “our”). Your participation in the Service constitutes your acceptance of these Mobile Terms of Service (“Mobile Terms”). If you do not agree to these Mobile Terms, do not enroll in or use the Service. We may update these Mobile Terms at any time, and continued participation in the Service following notice of changes constitutes acceptance of those changes.


Program Description

The Service allows users to receive recurring SMS/text messages from Darkstims Limited to the mobile number you provide. Messages may include:

  • Transactional communications: order confirmations, shipping updates, account alerts, service notifications, and other information related to purchases or your customer account.

  • Promotional communications: product announcements, cart reminders, offers, discounts, events, and other marketing materials.

Messages may be sent through an automated system, manual send, or other communication technology.


Consent and Eligibility

  • By enrolling, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction), are the account holder or authorized user of the mobile number provided, and have the authority to consent to receive messages.

  • Consent to receive marketing messages is not a condition of purchase. You may still make purchases without enrolling in the Service.

  • By providing your number, you expressly consent to receive recurring texts to that number, even if your number is listed on a do-not-call or do-not-text registry.


Costs and Frequency

  • Darkstims Limited does not charge for the Service.

  • Message and data rates may apply depending on your mobile carrier and plan.

  • Message frequency will vary depending on your interactions with us (e.g., cart activity, order updates, promotions).

  • You are solely responsible for all message, data, and other fees charged by your wireless provider.


Opt-Out and Support

  • To unsubscribe, text STOP to the number you receive messages from, or click the unsubscribe link (if available). You will receive a one-time confirmation message of your opt-out.

  • After this, you will no longer receive messages unless you opt back in.

  • To request assistance, text HELP or email us at help@darkstims.com.

  • If you subscribe to multiple messaging programs from Darkstims Limited, you must opt out separately from each program.


Your Responsibilities

  • You must provide accurate and valid information when enrolling.

  • If your mobile number changes, you must update your subscription or re-enroll with your new number.

  • You are responsible for ensuring that unauthorized individuals do not use your device to interact with the Service.

  • You acknowledge that opting in with someone else’s number without permission is prohibited and may be unlawful.


Service and Carrier Disclaimers

  • Wireless carriers (e.g., EE, O2, Vodafone, Three, and others) and Darkstims Limited are not responsible for:

    • Delayed, failed, or undelivered messages.

    • Errors in message content.

    • Misdelivery due to incorrect information provided by you.

  • Message delivery and performance depend on your wireless carrier and service availability.

  • The Service may not be available on all carriers or in all regions.


Limitation of Liability

To the maximum extent permitted by law, Darkstims Limited shall not be liable for any damages, losses, or claims arising out of:

  • Delays, failures, or misdelivery of messages.

  • Reliance on the content of messages.

  • Service interruptions, technical failures, or unauthorized access.

Your exclusive remedy is to discontinue participation in the Service.


Data Privacy

We respect your privacy. Personal data collected through the Service is processed in accordance with our Privacy Policy. This includes details on:

  • What data we collect (phone number, opt-in status, engagement).

  • How we use it (to send messages, improve performance, maintain compliance).

  • How long we retain it.

  • Your rights under GDPR, PECR, and CCPA (including access, correction, deletion, and opt-out of marketing).


International Users

The Service is intended for use within the United Kingdom but may be accessible elsewhere. By participating, you consent to the transfer of your information across borders and acknowledge that data may be processed outside your country of residence.


Governing Law

These Mobile Terms are governed by the laws of England and Wales. Any disputes will be resolved exclusively in the courts of England and Wales.
